Definitions
Customer the person who buys or agrees to buy the goods or service
from Secure Auto Track.
Conditions the terms and conditions of sale as set out in this document
and any special terms and conditions agreed in writing by Secure
Auto Track.
Goods the articles which the Customer agrees to buy from Secure
Auto Track.
Price the price for the Goods.
Conditions
2.1 These Conditions shall form the basis of the contract between
Secure Auto Track and the Customer in relation to the sale of Goods,
to the exclusion of all other terms and conditions including the
Customer's standard conditions of purchase or any other conditions
which the Customer may purport to apply under any purchase order
or confirmation of order or any other document.
2.2 All orders for Goods or Installation of Goods shall be deemed
to be an offer by the Customer to purchase Goods from Secure Auto
Track pursuant to these Conditions.
2.3 Acceptance of delivery and installation of the Goods shall be
deemed to be conclusive evidence of the Customer's acceptance of
these Conditions.
2.4 These Conditions may not be varied except by the written agreement
of Secure Auto Track.
2.5 These Conditions represent the whole of the agreement between
Secure Auto Track and the Customer. They supersede any other conditions
previously issued.
3.
Price
The Price shall be the price quoted on the Secure Auto Track's confirmation
of order.
4.
Payment and Interest
4.1 Payment of the Price shall be due at the time of installation.
5.
Goods
The quantity and description of the Goods shall be as set out in
the Secure Auto Track's confirmation of order.
6.
Warranties
Secure Auto Track warrants that the Goods will at the time of delivery
and installation correspond to the description given by Secure Auto
Track in the confirmation of order. Secure Auto Track warrants the
product to be of fitness for purpose, quality and condition as new
unless otherwise agreed and the installation is performed to a high
standard. Liability for the product or installation is limited to
the value of the replacement product or its refund
7.
Delivery / Installation of the Goods
7.1 Delivery/ installation of the Goods shall be made to the Customer's
choice of address. The Customer shall make all arrangements necessary
to be available to take delivery/ installation of the Goods on the
day notified by Secure Auto Track..
7.2 Secure Auto Track undertakes to use its reasonable endeavours
to arrive promptly for the installation of the Goods on an agreed
date, but does not guarantee to do so. Time of delivery shall not
be of the essence of the contract.
7.3 Secure Auto Track shall not be liable to the Customer for any
loss or damage whether arising directly or indirectly from the late
delivery or short delivery of the Goods. If short delivery does
take place, the Customer undertakes not to reject the Goods but
to accept the Goods delivered as part performance of the contract.
7.4 If the Customer fails to take delivery of the Goods on the agreed
delivery date or, if no specific delivery date has been agreed,
when the Goods are ready for dispatch, Secure Auto Track shall be
entitled to store and insure the Goods and to charge the Customer
the reasonable costs of so doing.
8.
Acceptance of the Goods
8.1 The Customer shall be deemed to have accepted the Goods [48
hours] after delivery to the Customer.
8.2 The Customer shall carry out a thorough testing of the Goods
within [48 hours] of installation and shall give written notification
to Secure Auto Track within 5 working days of delivery of the Goods
of any defects which a reasonable examination would have revealed.
8.3 Where the Customer has accepted, or has been deemed to have
accepted, the Goods the Customer shall not be entitled to reject
Goods which are not in accordance with the contract.
9.
Title and risk
9.1 Risk shall pass on delivery of the Goods to the Customer's address.
9.2 Notwithstanding the earlier passing of risk, title in the Goods
shall remain with Secure Auto Track and shall not pass to the Customer
until the amount due under the invoice for them (including interest
and costs) has been paid in full.
9.3 Until title passes the Customer shall hold the Goods as bailee
for Secure Auto Track and shall store or mark them so that they
can at all times be identified as the property of Secure Auto Track.
9.4 The Secure Auto Track may at any time before title passes and
without any liability to the Customer:
9.4.1 Secure Auto Track reserve the right to disable at IMEI level
any product not paid for, in preparation for product return. Re-instatement
of a unit at IMEI level will attract a charge of £30.00.
9.4.2 repossess and dismantle and use or sell all or any of the
Goods and by doing so terminate the Customer's right to use, sell
or otherwise deal in them; and
9.4.3 for that purpose (or determining what if any Goods are held
by the Customer and inspecting them) enter any premises of or occupied
by the Customer.
9.5 Secure Auto Track may maintain an action for the price of any
Goods notwithstanding that title in them has not passed to the Customer.
10.
RETURNS
10.1 Returns can only be accepted by prior arrangement. They are
strictly at the customers expense, we cannot refund for goods not
received, so please ensure a registered or "signed for"
post carrier is used.
10.2 If you have changed your mind, goods should be returned in
a resaleable condition i.e. original condition, with the wiring
loom in tact, with the instructions and packaging. Assuming all
is returned this will be regarded as in a resaleable condition,
and a full refund will be made. 10.2 Refunds will be made within
14days of receipt.
10.3 Should any goods not be returned in a resaleable condition
we may have to reduce or decline the refund.
11.
Faulty Goods.
11.1 We will always endeavour to solve any problems customers may
have, your first point of call should be to Tech Support via email
or by phone. Please allow 48hrs-72hrs (working days) for a response.
11.2 If a product is suspected to being faulty we may ask customers
to return goods, at their expense via registered post, for technical
evaluation. At that point, assuming within the 12 month warranty
period, we will either repair or replace the unit.
